Cherry Hill Broken Leg/Broken Arm Attorney

NJ Workers’ Compensation Lawyers

Nobody should suffer a workplace accident and suffer financially as a result of an injury. Under New Jersey workers’ compensation, victims of a workplace accident are entitled to wage replacement and coverage of their medical expenses.

At the Law Offices of Matarazzo & Lubcher, our Cherry Hill broken leg/broken arm attorneys help injury victims receive the compensation they deserve.

Leg or Arm Impairment

If a worker has injured his or her arm or leg, the employee may be able to continue working as long as modifications are implemented. Under the New Jersey Law Against Discrimination, an employer is required to provide the following for disabled employees:

However, the employer is not required to provide accommodation if it will be too expensive. The reasonableness of the accommodation will factor in the employer’s financial means. Examples of reasonable accommodations include asking for additional breaks, giving an employee additional time to complete an assignment, or moving an employee to a desk closer to the bathroom.

If an employer is unable to make reasonable accommodations in the employee’s normal position, the employee may need to take a lower-paying job temporarily. If the injury took place at work, the employee may apply for workers’ compensation benefits.

Temporary Disability Benefits

Under New Jersey workers’ compensation law, if an employee suffers an accident or injury and misses more than seven days of work, the individual can be eligible for temporary disability benefits. The worker will receive 70% of his or her average weekly wage. As of 2024, the maximum temporary disability rate is $1,131 per week.

Benefits will continue until the employee has reached maximum medical improvement (MMI), is returned to work, or has permanent restrictions. Determined by a physician, an employee is considered to reach MMI once a physician determines that an individual will no longer be likely to make any significant improvement.
